Refund Policy
1. Agreement Acknowledgment:
1.1 Upon entering into a contractual or informal agreement with Zigiwigi Digital Marketing ("Zigiwigi"), the client explicitly acknowledges and accepts that all services offered are governed by fixed, non-negotiable, and fully enforceable payment and refund clauses, established to protect intellectual investment, operational bandwidth, and resource allocation.
1.2 The client recognizes that Zigiwigi operates on a strict allocation system of intellectual labor, time capital, and creative deployment, all of which are assigned and scheduled prior to campaign execution. Any deviation, cancellation, or modification by the client does not automatically invite a financial reconsideration.
1.3 The mere dissatisfaction with aesthetic choices, opinion on ad style, lack of perceived engagement, or competitor comparison cannot be used to question or challenge Zigiwigi’s financial policies.
1.4 Once the onboarding process is initiated, and team resources are assigned, refund discussions are not entertained under any premise other than those explicitly mentioned herein.
2. Agency Fees:
2.1 Under no circumstances shall any agency fee, whether partial or full, be subject to refund, roll-over, transfer, or future adjustment. Agency fees are billed in recognition of strategic resource allocation, intellectual capital deployment, campaign ideation, and performance oversight. This applies irrespective of project outcome, client response, campaign performance, or mutual satisfaction.
2.2 Clients are advised to thoroughly review the scope of work and proposed deliverables prior to project initiation, as once agreed upon, agency effort billing becomes irrevocable.
2.3 Zigiwigi’s internal systems track resource time, ideation blocks, copywriting rounds, scheduling windows, and creative brief outputs. These cannot be reversed retroactively to accommodate refund requests.
2.4 Any delay in client-side decision-making, lack of timely input, or indecisiveness is not a valid justification for refund negotiation.
3. Split Payment Packages:
3.1 Any advance payment collected in packages where 50% is paid upfront and 50% post-result delivery is categorically classified as a non-refundable strategic deposit.
3.2 This amount is consumed against initial client onboarding, funnel structuring, research, copywriting, asset generation, and time-blocking within our operational calendar.
3.3 Delay or non-cooperation from client end does not constitute grounds for refund or compensation.
3.4 Any disputes about result delivery must be substantiated through mutually signed expectations document, inclusive of KPIs, timeline charts, and objective scoring matrices.
4. Discounted Advance Packages:
4.1 In packages where a discounted advance payment model is applied (3-month or 6-month retainers), the entire payment is locked, non-refundable, non-transferable, and considered time-blocked commitment capital.
4.2 These engagements receive strategic resource preference, pricing flexibility, and planning priority.
4.3 Client’s withdrawal, dissatisfaction, or intent to cancel midway will have no financial remedy or recourse.
4.4 Discounts are provided based on long-term commitment, which voids any possibility of early termination refund eligibility.
5. Video Shoot Fees:
5.1 Video production services rendered by Zigiwigi, whether involving local or outstation shoots, are subject to strict refund timelines.
5.2 If the shoot is cancelled 10 or more calendar days before the scheduled date, a 90% refund of the shoot fee is processed.
5.3 Cancellation within a window of 3–9 days permits a refund of 25% only.
5.4 Any cancellation post 72 hours or after dispatch of the crew from base location voids refund eligibility completely.
5.5 Post-production dissatisfaction does not equate to refund legitimacy.
5.6 All raw footages, edited reels, music licenses, or set design costs are sunk costs and are thus not refundable.
6. Meta Ads via Zigiwigi Account:
6.1 Where Meta ads are involved and executed under Zigiwigi’s proprietary ad accounts, the full monthly budget must be deposited no less than 30 days in advance.
6.2 No extra charges are levied beyond media spend.
6.3 Clients understand that all funds are immediately allocated to platform-based ad auctioning, A/B testing, split testing, and optimization cycles.
6.4 Under no condition will Zigiwigi refund any unused or remaining budget, even in the event of campaign underperformance.
6.5 Refund requests due to algorithm changes, platform bans, or external suspension shall not be honored.
6.6 Ad creative approvals delayed by client will not be considered a Zigiwigi fault nor justification for refund.
7. Meta Ads via Client Account:
7.1 In client-managed Meta ad accounts, where Zigiwigi acts as a strategic performance partner, the client bears complete responsibility for setup, configuration, access provisioning, pixel/event code accuracy, and ad account readiness.
7.2 Failure in any of these parameters absolves Zigiwigi of execution liability.
7.3 A monthly service charge of ₹10,000 is applicable, billed in advance and non-refundable regardless of media spend, ad performance, or campaign interruptions.
7.4 Failure to provide timely access or post-approval delays due to client-side error or confusion shall not permit any renegotiation of fees.
7.5 Technical malfunctions on the client's ad account side are solely client responsibility.
8. Lead Guarantee Protocol:
8.1 In case Zigiwigi is expected to demonstrate results as per any form of guarantee, clients must adhere to predefined lead management protocols.
8.2 This includes but is not limited to: maintaining a lead tracking sheet issued by Zigiwigi, updating prospect statuses in real-time, noting call attempts and outcomes, and responding to internal audit queries regarding lead closure ratios.
8.3 Failure to maintain this sheet in its original format will nullify all performance-based commitments and void guarantee-related disputes.
8.4 Clients attempting to falsely claim non-performance without proper sales data and lead status trails shall be disqualified from any refund discussion.
8.5 Internal sales follow-up negligence or CRM mismanagement are client liabilities.
9. Sales Result Dependency:
9.1 Any claim of "no result" or "non-delivery" must be substantiated with documented proof of sales team efforts, follow-up records, missed call reports, and CRM status snapshots.
9.2 Zigiwigi holds the right to cross-verify sales process adherence before any conversation of refund, extended service, or compensation.
9.3 Zigiwigi may request recorded call logs or written chat trails for lead qualification validation.
9.4 Fake claims or manipulation of result tracking shall lead to immediate termination of services and forfeiture of all pending service scopes.
10. Account Access & Data:
10.1 Zigiwigi does not provide access to its internal advertising accounts, ad sets, audience targeting libraries, or backend dashboards due to proprietary security protocols.
10.2 Clients may receive detailed reports, insights, performance screenshots, and summary decks but cannot demand raw access to internal control systems.
10.3 Any attempt to gain backend access through third-party monitoring tools or unauthorized interventions will be considered a breach of operational trust.
11. Confidential Information:
11.1 All materials, data, concepts, scripts, strategies, and creatives shared by Zigiwigi remain the sole intellectual property of the agency.
11.2 Unauthorized sharing, copying, or redistribution will trigger immediate legal action and engagement termination.
12. Client Non-Cooperation:
12.1 In instances of client non-cooperation, prolonged unresponsiveness (exceeding 7 business days), repeated delays in approvals, incomplete briefs, or erratic behavior detrimental to workflow continuity, Zigiwigi reserves the irrevocable right to halt campaign activity, relinquish service obligations, and terminate the engagement without financial restitution.
12.2 Clients are advised to maintain regular contact via email or formal WhatsApp groups to ensure operational alignment.
12.3 Missed deadlines due to client-side delays will not impact Zigiwigi’s billing cycles.
13. Case Study Disclaimers:
13.1 Any comparative reference to previous client outcomes, brand success stories, viral campaigns, or ROI multipliers displayed in our promotional videos, testimonials, decks, images, or online media is purely for illustrative and educational purposes.
13.2 Clients acknowledge that performance is subject to industry, seasonality, geography, ad copy, visual impact, client responsiveness, and innumerable dynamic variables.
13.3 Case study replication is not legally nor operationally promised by Zigiwigi.
14. Governing Communication & Escalation:
14.1 All disputes regarding services rendered, refunds, or campaign efficacy must be submitted in writing to our grievance cell.
14.2 Email: support@zigiwigi.com. No phone-based negotiations, WhatsApp discussions, or verbal resolutions shall be considered valid or binding.
14.3 Clients are advised to retain documentation of all payment receipts, deliverable trackers, and written communications for conflict resolution.
15. Payment Consent:
15.1 By initiating any payment to Zigiwigi via UPI, bank transfer, cash, cheque, or online gateway, the client fully consents to the aforementioned terms and acknowledges the non-refundable nature of our fee structures.
15.2 These policies are governed by ethical business conduct and industry-standard compliance expectations.
15.3 All policies are subject to periodic update without prior notice and will be binding from the moment of publication on Zigiwigi’s official communication channels.
16. Result Dependency Clause:
16.1 Client acknowledges and accepts that performance outcomes depend on multiple uncontrollable external and internal factors, including but not limited to: product reputation, dealer/distributor reliability, client-side payment terms, local and national competition, product quality, after-sales service, market trends, and the prevailing economic condition.
16.2 Under no circumstances shall Zigiwigi be held responsible for lack of expected results due to these externalities.
16.3 Campaign performance cannot be used as a standalone reason for refund if the client-side environment is not conducive for growth.
16.4 Zigiwigi reserves the right to assess market conditions before proceeding with strategy adaptations, without affecting prior financial commitments.
